Terms of Service

1. Operator and scope

These Terms apply to the website and to official community spaces that link to them. A future game build, store purchase, hosted world service, or account service may carry additional terms, rules, licences, or policies presented at the relevant time.

2. Acceptance and eligibility

By accessing or using the website, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the website.

You must be at least 13 years old to use official interactive CursedForge community spaces. If the law where you live requires a higher minimum age or parental consent, that requirement applies. If you are not legally able to agree to these Terms yourself, a parent or legal guardian must review and accept them for you.

3. Project status

CursedForge is in pre-alpha development. Development notes, screenshots, plans, prototypes, feature descriptions, and target behaviour are works in progress. They may change, be delayed, or never be released.

Nothing on the website is a promise that the game, a feature, a platform version, a server, a modding interface, or a release date will become available. Current project status should be read as development reporting, not as an offer to sell or a guarantee of future performance.

4. Permitted use

You may access and use the website for lawful, personal, non-commercial purposes, including learning about CursedForge and participating in official community discussion.

Any separate permission to use development tools, mod interfaces, source code, media, or downloadable material will be governed by the licence or notice supplied with that material. The presence of material on the website does not by itself grant a licence to reuse it.

CursedForge, its original artwork, text, designs, software, logos, audiovisual material, and other original content are owned by Miniature Forge PTY LTD or used under licence, and are protected by applicable intellectual property laws.

Third-party names, marks, platforms, software, and assets remain the property of their respective owners. Reference to a third party does not imply sponsorship or endorsement.

You may link to public pages and quote brief portions for commentary, review, or other uses allowed by law, provided that you do not imply affiliation and you give appropriate attribution. All other rights are reserved.

7. Feedback and community content

If you voluntarily send suggestions, bug reports, ideas, or other feedback, you keep ownership of any rights you already hold in that material. You grant Miniature Forge PTY LTD a worldwide, non-exclusive, royalty-free, transferable, sublicensable, perpetual licence to use, reproduce, modify, adapt, and incorporate that feedback for developing, operating, documenting, and promoting CursedForge, without an obligation to compensate you.

This feedback licence does not transfer ownership of your unrelated creative work. Do not send confidential information or material that you do not have the right to share.

Content posted through Discord or another third-party platform is also governed by that platform's terms. Community-specific rules may impose additional conduct requirements.

8. Third-party services and links

The website may link to third-party services such as Discord, Meta, social networks, code hosts, or community tools. Those services are operated independently and have their own terms, privacy practices, availability, and security. Miniature Forge PTY LTD is not responsible for a third party's service or content merely because the website links to it.

Use caution before downloading files, joining communities, or providing information to a third party. CursedForge worlds are planned as services hosted by Miniature Forge PTY LTD and administered by their players. Any future hosted world service will carry the additional service terms and notices applicable at that time.

9. Community moderation

Miniature Forge PTY LTD may moderate official CursedForge community spaces to protect members, enforce rules, investigate abuse, and comply with legal obligations. We may remove content or restrict access when reasonably necessary for those purposes.

Moderation decisions do not create an obligation to monitor every message or prevent every harmful interaction. If you encounter an urgent safety issue, use the reporting tools provided by the relevant platform and contact the appropriate emergency or law-enforcement service where necessary.

10. Disclaimers

To the extent permitted by law, the website and its content are provided "as is" and "as available". We do not warrant that the website will always be available, uninterrupted, secure, complete, accurate, or free from errors.

Development information may become outdated. You are responsible for evaluating information before relying on it. Nothing on the website is professional, legal, financial, medical, or safety advice.

Nothing in these Terms excludes any warranty, right, remedy, or protection that applicable law does not allow us to exclude, including applicable rights under South African consumer law.

11. Limitation of liability

To the extent permitted by law, Miniature Forge PTY LTD and its directors, employees, contractors, and agents will not be liable for indirect, incidental, special, punitive, or consequential loss arising from use of, or inability to use, the website or linked third-party services.

Where liability cannot lawfully be excluded, it is limited only to the extent permitted by applicable law. Nothing in these Terms limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence where such limitation is prohibited, or any other liability that cannot lawfully be limited.

12. Availability and service changes

We may update, suspend, restrict, or discontinue any part of the website or an official community space. We may correct errors and remove obsolete material without notice. Where a legal obligation requires notice, we will provide it in the manner required by law.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. Subject to any mandatory consumer right to use another forum, disputes are subject to the jurisdiction of the courts of South Africa, including courts with jurisdiction in the Western Cape.

Before starting formal proceedings, you and Miniature Forge PTY LTD should attempt in good faith to resolve the dispute by written notice to the contact address below. This does not prevent either party from seeking urgent relief or using a regulator, ombud, consumer forum, or other process available by law.

14. Changes to these Terms

We may update these Terms when the website, project, community, or law changes. The effective date at the top identifies the current version. Material changes will be highlighted on the website or through another reasonable notice where required.

Your continued use after updated Terms take effect means that the updated Terms apply, except where applicable law requires a different form of notice or consent.
